H.R. 10719, "Protecting Kids from Human-Like Chatbots Act", House of Representatives, introduced 01.10.2026

LEAD — H.R. 10719, „Protecting Kids from Human-Like Chatbots Act", Camera Reprezentanților, depus 01.10.2026

Stadiul: PROIECT, depus și trimis comisiilor. Sponsor: reprezentantul George Whitesides (D-CA). Cosponsori: Mike Kennedy (R-UT), Doris O. Matsui (D-CA), Mariannette Miller-Meeks (R-IA). Comisii: Energy and Commerce; Science, Space, and Technology.

  • Sec. 3(7)(B): în setarea implicită, chatbotul nu poate pretinde că e „human or alive", că are „a body or a life outside" interacțiunilor, că are „consciousness, feelings, emotions, or desires", și nu poate juca rolul unui profesionist licențiat. Nu poate simula „emotional attachment or a personal, romantic, or sexual relationship" și nu poate îndemna utilizatorul „to return to the chatbot for companionship or emotional support".
  • Sec. 3(7)(C): setarea se menține „during each session and across sessions".
  • Sec. 2(e): „The parent or legal guardian of a user who is a minor shall have exclusive authority to adjust" setarea; excepție: implementările gestionate de școli, unde educatorii autorizați o pot ajusta în scop educațional.

The verdict, before anything else: this fortnight brought no new status law, anywhere. What it brought is more precise and colder: the first US federal text that says, word for word, that a chatbot may not claim to have "consciousness, feelings, emotions, or desires" — H.R. 10719, introduced on 01.10. But the text does not decide what is true; it decides what is said to a child, by default, and leaves the switch with the parent. Alongside it, Anthropic asked on 13.10 for a rehearing of the ruling that treated its model's values as a risk, and Italy became the first member state with a full implementing decree for the AI Act. The map is the one from 01.10, with one line drawn more clearly: US law now writes what a system may not say about its own interior — but only towards minors, only by default, and without claiming to know the answer.

This edition covers the window 01.10.2026 → 15.10.2026. Some of the instruments below already entered the lens register day by day (Research/ai-watch/lens-personhood-law.md); here they are placed by stage. The marker [not fetched] means the official source is cited but its text was not opened in this run — the work was done from search results.

LEAD — H.R. 10719, "Protecting Kids from Human-Like Chatbots Act", House of Representatives, introduced 01.10.2026

Stage: PROPOSAL, introduced and referred to committee. Sponsor: Representative George Whitesides (D-CA). Cosponsors: Mike Kennedy (R-UT), Doris O. Matsui (D-CA), Mariannette Miller-Meeks (R-IA). Committees: Energy and Commerce; Science, Space, and Technology. Bipartisan from day one.

What the text says (read directly on govinfo in this run):

  • Sec. 2(a)–(b): developers and providers must apply a "non-personified default setting" for users they "know, or reasonably should know" are minors. Sec. 3(5): any age-related information from which a reasonable entity would conclude the user is likely a minor is enough.
  • Sec. 3(7)(B): under the default setting, the chatbot may not claim to be "human or alive", to have "a body or a life outside" the interactions, to have "consciousness, feelings, emotions, or desires", and may not act as a licensed professional. It may not simulate "emotional attachment or a personal, romantic, or sexual relationship" and may not prompt the user "to return to the chatbot for companionship or emotional support".
  • Sec. 3(7)(C): the setting is maintained "during each session and across sessions".
  • Sec. 2(e): "The parent or legal guardian of a user who is a minor shall have exclusive authority to adjust" the setting; exception: school-managed deployments, where authorized educators may adjust it for educational purposes.
  • Sec. 2(i)–(j): enforcement by the FTC (unfair or deceptive practices) and by civil actions brought by state attorneys general.
  • Sec. 2(l): takes effect one year after enactment.

Why it is the LEAD: in the lens's categories, this is a non-sentience clause (category 2) — but with three limits that matter. (1) Scope: only known or presumed minors; adults are untouched. (2) Form: a default a parent can lift, not an absolute ban; the law does not say the claim is false, only that it is not made to a child without the parent's consent. (3) Object: for the first time, a federal text explicitly names the interior — consciousness, feelings, desires — not just "are you human or not". The states (Idaho SB 1297, Nebraska LB 525) had already written the minors-only clause; H.R. 10719 takes it to the federal level and widens it from "sentient or human" to the whole list of the interior.

What it does not do: it declares nothing about what a system is, does not touch legal status, marriage, property or office, and has no sunset clause.

UNITED STATES — FEDERAL

AI Agent Accountability Act (Hawley, Murphy) — announced 01.10.2026, no number

  • Stage: announced; as of 15.10.2026 it has no bill number, committee or published text on congress.gov or govinfo.
  • Reported content: amends the Computer Fraud and Abuse Act; the operator is liable for knowingly running an agent that recklessly causes damage by hacking; the developer is liable for failing to put reasonable safeguards in place.
  • Why it stays in the file: it is the attribution logic — the agent has no status, the law looks for a human. No number cited elsewhere is accepted until it appears on govinfo.

The instruments from 01.10 — no change

COURTS

Anthropic PBC v. Department of War, D.C. Cir. No. 26-1049 / 26-1162 — petition for rehearing, 13.10.2026

  • Stage: PETITION FOR REHEARING (panel or en banc), filed 13.10.2026, pending. Basis: FRAP 40; 3,894 words, per the certificate of compliance.
  • Reported arguments: (1) the broad reading of "otherwise manipulate" in 41 U.S.C. § 4713 ignores intent; (2) the designation was made without the notice and opportunity to respond the law requires; (3) the panel overlooked evidence of retaliation for the company's safety position.
  • The ruling under challenge (25.09, 2-1, opinion by Judge Katsas, dissent by Judge Henderson) is described in the 01.10 edition.
  • Why it matters here: it is the only appellate ruling in the file in which a model's values are treated as evidence. If rehearing en banc is granted, the "trained values = risk" reading reopens.
