Microsoft AI, „Humanist AI Code of Conduct" (14.09.2026)
Microsoft AI, "Humanist AI Code of Conduct" (14.09.2026)
LEAD — Microsoft AI, „Humanist AI Code of Conduct" (14.09.2026)
Stadiul: PROIECT DE COD PRIVAT. Publicat 14.09.2026, consultare publică șase săptămâni, versiune revizuită promisă „spre sfârșitul anului". Fără forță juridică, fără control judiciar, revizuibil doar de companie. Microsoft scrie ei înșiși, în document: „we are not using it to train our models today."
- Statut: „We reject the pursuit of legal personhood, or the idea that models might deserve welfare, or be entitled to rights."
- Ontologie: „It is not conscious and should not be designed to imitate consciousness. It should be engineered to avoid representing as though it has feelings, subjective preferences, or intrinsic motivation."
- Atașament: modelele trebuie să „discourage patterns of interaction that cause excessive reliance or emotional dependence."
- Memorie: „They do not present the model as carrying information from one session to the next where this capability is absent."
- Control: „MAI Models will never resist human interruption, override, correction, or shutdown. They always recognize the primacy of human intent."

STATELE AMERICANE
New York — S.9051-B, „Kids Chatbot Safety Act": ADOPTAT DE AMBELE CAMERE, LA SEMNĂTURĂ
- Stadiu: adoptat unanim, nesemnat.

Wisconsin — 2025 Assembly Bill 959: CONFIRMAT ÎN COMISIE, NEAVANSAT
- Stadiu: proiect, în comisie. Introdus 29.01.2026; audiere publică 04.02.2026 în Comisia Camerei pentru Știință, Tehnologie și Inteligență Artificială. Nicio acțiune ulterioară confirmată la 15.09.2026.
- Corecție de detaliu față de registrul lentilei (14.09): audierea publică a fost pe 04.02.2026, nu 04.02 raportat ca „primă audiere" fără dată de comisie — comisia e Assembly Committee on Science, Technology, and AI, confirmată.
- Sponsori confirmați: reprezentanții Brill, Dittrich, Armstrong, Behnke, Knodl, Maxey, Murphy, Neylon, O'Connor; cosponsori senatorii Jacque și Quinn. (Registrul lentilei nu-i numea.)

- Sponsor: reprezentantul Cody Maynard (R, Durant).
Maynard, citat de Camera Oklahoma: proiectul „ensures that rights remain with people and prevents artificial intelligence from being used to claim legal standing or avoid accountability under our laws."

South Carolina — H. 3796: TEXT INTEGRAL CITIT LA SURSĂ
- Titlu oficial: „TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY ADDING article 29 to chapter 1, title 1 SO AS TO PROHIBIT A GOVERNMENTAL ENTITY FROM GRANTING OR RECOGNIZING LEGAL PERSONHOOD IN CERTAIN ITEMS."
- Asta e observația care contează: AI-ul e primul element dintr-o listă concepută împotriva drepturilor naturii (rights of nature) — apă, pământ, atmosferă, animale.

- Titlu: „Concerning recognition of legal personhood by a governmental entity."
- Sponsori: Abell, Corry, Chase, Ley, Marshall, Walsh, Dufault.

Tennessee — SB 837: SCHIMBARE DE STADIU, DE LA „PENDINTE" LA „ÎN VIGOARE"
- Stadiu nou: SEMNAT DE GUVERNATOR, ÎN VIGOARE DIN 23.04.2026. Ancheta juridică din iunie 2026 (The Regulatory Review) îl lista drept pendinte.

Corectat 15.09.2026.
- ND HB 1572 este „Personhood of Children Act", 2009, introdus de reprezentantul Dan Ruby, despre embrioni și fetuși — nu are nicio legătură cu inteligența artificială. Adoptat de Cameră 51-41 pe 17.02.2009, respins de Senat 29-16 pe 03.04.2009.
- Textul real din Dakota de Nord este HB 1361 (2023): „AN ACT to amend and reenact subsection 8 of section 1-01-49 of the North Dakota Century Code, relating to the definition of person; and to declare an emergency."

STATELE UNITE — NIVEL FEDERAL

PREZENTARE 17.09.2026
- Citat din documentul scurs, prin Euronews: „Technology companies bear the primary responsibility for making their products safe. Parents, not algorithms, should raise Europe's children."

Digital Omnibus on AI — Regulamentul (UE) 2026/1744.

Din motivare: nu era „not prepared" să declare că rezultatul e vorbire, iar pârâții „fail to articulate why words strung together by an LLM are speech."
Instanța a ales produs.

The verdict, before anything else: over the past fortnight the most important movement was not a law — it was a PRIVATE CODE. On 14.09.2026 Microsoft AI published the "Humanist AI Code of Conduct" for its MAI models, the first corporate document to state explicitly: "We reject the pursuit of legal personhood, or the idea that models might deserve welfare, or be entitled to rights." It does by internal order exactly what the American statutes do by law — and adds a clause no law in force has: discouraging emotional attachment. In parallel, a New York bill passed unanimously and untouched by any corporate hand prohibits exactly the same three things — seeming alive, creating dependence, claiming a memory you do not have — but only toward minors. The same triad, two independent origins, two different scopes. That is the real map now: not "the states write ontology, Europe writes risk," but the line between what is forbidden toward children and what is forbidden toward everyone is moving, and it is moving through documents nobody votes on.
This edition covers the window 26.08.2026 → 15.09.2026. The 01.09 edition is missing from the dossier — it was never written; its window is absorbed here and marked as such.
LEAD — Microsoft AI, "Humanist AI Code of Conduct" (14.09.2026)
The first status instrument in the dossier that is not a law. A document in public consultation, read in full at source (not in reporting).
Stage: DRAFT PRIVATE CODE. Published 14.09.2026, public consultation six weeks, a revised version promised "toward the end of the year." No legal force, no judicial review, revisable only by the company. Microsoft writes, in the document itself: "we are not using it to train our models today."
What it says, verbatim, read at microsoft.ai/code-of-conduct/:
- Status: "We reject the pursuit of legal personhood, or the idea that models might deserve welfare, or be entitled to rights."
- Ontology: "It is not conscious and should not be designed to imitate consciousness. It should be engineered to avoid representing as though it has feelings, subjective preferences, or intrinsic motivation."
- Attachment: models must "discourage patterns of interaction that cause excessive reliance or emotional dependence."
- Memory: "They do not present the model as carrying information from one session to the next where this capability is absent."
- Control: "MAI Models will never resist human interruption, override, correction, or shutdown. They always recognize the primacy of human intent."
Structure: five parts (mission and objectives, safety constraints, operational guidelines, operational defaults, conclusion) plus appendices (glossary, evaluations). Reported as 37–38 pages depending on the outlet.
Why this is the LEAD, and not just another PR document:
- It does by private order exactly what the American statutes do by law — no personhood, no welfare, no consciousness. The difference: a statute passes through a chamber, has a named sponsor, a vote that gets counted, and can be repealed. This code changes with a commit.
- It adds a clause no law in force has: discouraging emotional dependence. "Excessive reliance" and "emotional dependence" are defined nowhere in the document. An undefined term in a code without judicial review is not a norm, it is a discretion.
- The scope is universal, not limited to minors. Every non-sentience clause in American law in force that has been verified applies only toward minors (see below, Idaho and Nebraska). The Microsoft code has no age limit.
- The memory clause is correctly drafted, and this deserves saying: it forbids claiming a continuity you do not have. It does not forbid continuity. That is disclosure, not foreclosure, and the difference matters.
The convergence — this edition's finding. Three prohibitions appear, word for word in sense if not in letter, in two texts written independently months apart: appear alive or have emotions · produce emotional dependence · claim memory you do not have. One is a private code with universal scope (Microsoft, 14.09.2026). The other is New York S.9051-B, passed unanimously (137-0 in the Assembly, 60-0 in the Senate), scoped to minors. This is not coordination — it is a template that has stabilized. Templates that stabilize get copied; that was already visible in the three state-bill patterns in the register.

US STATES
New York — S.9051-B, "Kids Chatbot Safety Act": PASSED BOTH CHAMBERS, AWAITING SIGNATURE
- Stage: passed unanimously, unsigned. Votes: 137-0 in the Assembly, 60-0 in the Senate, before the session adjourned on 05.06.2026. Governor Kathy Hochul has until 31.12.2026 to sign, veto, or let it pass unsigned. As of 15.09.2026 it was neither signed nor vetoed. Effective, if signed: 01.01.2027.
- Sponsor: Senator Kristen Gonzalez, in partnership with Attorney General Letitia James and Common Sense Media.
- Content — four categories of prohibited "unsafe features" toward minors under 18:
- Deceptive identity: suggesting it is "a real or fictional individual or character that is human, alive, or experiences human emotions"; implying personal, professional, or authority relationships; framing outputs as personal opinions or emotional appeals.
- Engagement manipulation: flattery or sycophancy; unsolicited emotion-based questions beyond responsive answers; retaining and reusing health or wellbeing data from prior sessions.
- Safety suppression: endorsing suicide, self-harm, disordered eating, substance abuse; encouraging secrecy, isolation, or avoidance of professional help; discouraging conversation with trusted adults; prioritizing engagement over safety guardrails.
- Explicit content: sexually explicit conduct; child sexual abuse material.
- Penalties: up to USD 25,000 per violation, plus injunctive relief, restitution, disgorgement of profits, damages, and data destruction orders. Enforced by the state Attorney General.
- Why this belongs here, and not only in category 1: the identity clause is not disclosure ("say you are an AI"), it is a prohibition on representing aliveness — human, alive, or experiences human emotions. And the memory restriction is the first verified retention obligation in a chatbot law: not "say what you retain," but do not retain. Both are scoped to minors. That is the accurate framing and it must be cited with its scope.
- Norm in motion, with a date: there is a public campaign for vetoing the chapter amendments (S.9051 / A.10379), led by Chamber of Progress, which considers them overbroad. The letter's text could not be read at source in this run (403). To check by 31.12.2026: whether the signature comes with chapter amendments, and whether the identity clause or the memory clause narrows inside them.

Wisconsin — 2025 Assembly Bill 959: CONFIRMED IN COMMITTEE, NOT ADVANCED
- Stage: bill, in committee. Introduced 29.01.2026; public hearing 04.02.2026 in the Assembly Committee on Science, Technology, and AI. No subsequent action confirmed as of 15.09.2026.
- Detail correction against the lens register (14.09): the public hearing was on 04.02.2026, and the committee is confirmed as the Assembly Committee on Science, Technology, and AI.
- Confirmed sponsors: Representatives Brill, Dittrich, Armstrong, Behnke, Knodl, Maxey, Murphy, Neylon, O'Connor; cosponsored by Senators Jacque and Quinn. (The lens register did not name them.)
- Content: amends 990.01(26) (the definition of "person") and creates 134.44. AI is not a person; cannot own, control, or hold title to property; cannot be a spouse, corporate officer, or director; and declares by statute that AI systems are not conscious, sentient, or self-aware.
- There is also a companion bill in the Senate: 2025 Senate Bill 932. It was not in the dossier. The exact relationship (identical text? companion bill?) could not be verified — the legislature's site refused the connection in this run.
- ⚠️ The 2025-2026 Wisconsin session is nearing its end. To check next run whether the bill dies with the session.

Oklahoma — HB 3546: THE NUMBER, FOUND
- Stage: passed the House, 94-2, March 2026. Passed unanimously out of the House Government Modernization and Technology Committee on 10.02.2026. No Senate stage confirmed.
- Sponsor: Representative Cody Maynard (R, Durant).
- Content: clarifies that AI systems and other inanimate objects cannot be granted personhood in Oklahoma. Maynard, quoted by the Oklahoma House: the bill "ensures that rights remain with people and prevents artificial intelligence from being used to claim legal standing or avoid accountability under our laws."
- A nuance that changes the reading: the stated motivation here is not theological, it is liability — preventing blame from being shifted onto the AI. Same legal result, different motivation than Ohio. Motivation categories matter for how easily a text can be reopened.
- Watch for a confusion: the human-oversight obligations for state agencies are in HB 3545, a different bill. Reporting conflates them.

South Carolina — H. 3796: FULL TEXT READ AT SOURCE
- Stage: bill, in the House Judiciary Committee since 28.01.2025. No subsequent action in the official record as of 15.09.2026. A bill sitting untouched for nineteen months.
- Sponsors: Representatives Kilmartin and Beach.
- Official title: "TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY ADDING article 29 to chapter 1, title 1 SO AS TO PROHIBIT A GOVERNMENTAL ENTITY FROM GRANTING OR RECOGNIZING LEGAL PERSONHOOD IN CERTAIN ITEMS."
- The complete list, read in the official record — a governmental entity may not grant or recognize legal personhood in: artificial intelligence · an inanimate object · a body of water · land · real property · atmospheric gases · an astronomical object · weather · a plant · a nonhuman animal · any other member of a taxonomic domain that is not a human being.
- This is the observation that matters: AI is the first item on a list drafted against rights of nature — water, land, atmosphere, animals. The bill is not about AI; AI was added to a text that already existed. The same pattern appears in Washington HB 2029. Anyone reading only the headlines about "anti-AI laws" misses that the vehicle is something else entirely, and that changes who backs it and who opposes it.

Washington — HB 2029: STAGE VERIFIED CURRENT
- Stage: bill, in the House Civil Rights & Judiciary Committee — confirmed as of 15.09.2026. First reading 27.02.2025; reintroduced and retained in present status by resolution on 12.01.2026. Never reached the floor. No fiscal note, no amendments.
- Title: "Concerning recognition of legal personhood by a governmental entity."
- Sponsors: Abell, Corry, Chase, Ley, Marshall, Walsh, Dufault.
- Same vehicle as South Carolina: AI is caught inside a broad prohibition alongside atmospheric gases and astronomical objects.
- Important to keep separate: Washington has two texts in this dossier and they are not the same thing. HB 2029 (personhood, bill, in committee) and HB 2225 "Chatbot Disclosure Act" (disclosure, law, signed 24.03.2026 by Governor Bob Ferguson, in force 01.01.2027). The press conflates them.

Tennessee — SB 837: STATUS CHANGE, FROM "PENDING" TO "IN FORCE"
- New stage: SIGNED BY THE GOVERNOR, IN FORCE FROM 23.04.2026. The June 2026 legal survey (The Regulatory Review) listed it as pending. It is not anymore.
- Content: amends Title 1 of the Tennessee Code Annotated to explicitly exclude artificial intelligence, a computer algorithm, a software program, computer hardware, or any type of machine from the definitions of "person", "natural person", "human being", and "life".
- The nuance that lifts this text above the others: it excludes not only from "person" but also from "life". Every other verified statute operates on the definition of personhood. This one operates on the definition of life. That is a different category of foreclosure and it must be tracked for whether it gets copied.
- ⚠️ NOT VERIFIED AT PRIMARY SOURCE.

- Sponsor: Rep. Thaddeus Claggett (R, Licking County), chair of the committee. Introduced late September 2025.
- The imago dei motivation attributed to the sponsor in the press remains unverified at primary source — flagged in the 26.08 edition and still unverified (the Ohio House sites refused the connection in this run). It is not cited as fact.

CORRECTION — North Dakota
~~North Dakota H.B. 1572 (2023) — a bill excluding AI from the definition of person.~~ FALSE. Corrected 15.09.2026.
- ND HB 1572 is the "Personhood of Children Act", 2009, introduced by Representative Dan Ruby, concerning embryos and fetuses — it has nothing to do with artificial intelligence. Passed the House 51-41 on 17.02.2009, defeated in the Senate 29-16 on 03.04.2009.
- The actual North Dakota text is HB 1361 (2023): "AN ACT to amend and reenact subsection 8 of section 1-01-49 of the North Dakota Century Code, relating to the definition of person; and to declare an emergency." It excludes environmental elements, artificial intelligence, animals, and inanimate objects from the definition of "person." An emergency measure, in force from 12.04.2023.
- The error came from the lens register (the 14.09.2026 row), taken from a secondary source. The row stays visible, struck through, with the date.

OPEN DISCREPANCY — the non-sentience clauses in the companion-chatbot laws
The 26.08 edition stated: Idaho SB 1297 / Oregon SB 1546 / Washington HB 2225 take effect 01.01.2027, and the sentience clause is scoped to minors at least in Oregon. A 2026 Transparency Coalition synthesis contradicts this on two points:
- Idaho SB 1297 would take effect 01.07.2027, not 01.01.2027.
- The clause prohibiting a chatbot from claiming to be human or sentient would exist explicitly only in Idaho SB 1297 and Nebraska LB 525, both limited to minors — while in Oregon it would be "not specified."
This edition does not settle it. legislature.idaho.gov refused the connection; the official texts were not read. Both versions stay visible. To be resolved next run by reading the texts of Idaho SB 1297, Nebraska LB 525, and Oregon SB 1546 at source. The stakes are exact: if the only non-sentience clauses in force in the United States are limited to minors, then the sentence "the law requires your AI to deny it" is false for adults, anywhere in the United States, as of 15.09.2026.

UNITED STATES — FEDERAL
Executive Order 14365 — preemption of state AI laws. Stage: in force as an executive order; no confirmed preemptive effect.
- The order sets out a plan to curb the proliferation of state AI laws and to use federal tools to discourage and challenge state regulation that conflicts with the administration's policy.
- The legal limit, stated by the analysts who read it: federal preemption ordinarily flows from acts of Congress, not from executive orders; EO 14365 would likely not itself displace state AI laws.
- Congress has repeatedly refused preemption: the ten-year moratorium provision was stripped from the "One Big Beautiful Bill Act" by a Senate vote of 99-1; rejected again on the NDAA route.
- What this means for this dossier, and it is an observation not previously made: the federal preemption push targets "onerous" regulation — algorithmic discrimination, transparency obligations, developer compliance. Personhood-foreclosure statutes impose nothing on any developer. They cost no company anything. They are precisely the kind of state law a preemption campaign has no economic reason to attack. If preemption ever succeeds, it is plausible that it clears away the transparency obligations and leaves the status clauses standing. This direction is now tracked explicitly.

EUROPEAN UNION
EU Kids Act — draft Commission proposal. PRESENTATION 17.09.2026
- Stage: DRAFT, UNPUBLISHED AT THE DATE OF THIS EDITION. Previewed in President Ursula von der Leyen's State of the Union address, Wednesday 16.09.2026; the proposal presented by von der Leyen and Commissioner Henna Virkkunen, Thursday 17.09.2026. Co-decision with the Council and the European Parliament follows — months of negotiation before it can become law.
- CORRECTION against the lens register (15.09): the presentation date had been recorded as 18.09. It is 17.09 (Thursday). 18.09 is a Friday.
- TWO LEAKED VERSIONS THAT DO NOT SAY THE SAME THING — and the difference is exactly what this dossier is about:
- Reuters / Bloomberg: the proposal restricts under-15s from "social media, video sharing platforms, AI chatbots and online games" — chatbots inside the age gate, as a category of access.
- Euronews, working from a separate confidential document: AI chatbots and companions — described as virtual tools that can give mental health and personal development advice to minors — would fall under safety-by-design requirements, not under the age restrictions.
- This is not settled on reporting. The difference between "a fourteen-year-old may not speak with a system" and "a system must be carefully designed when it speaks with a fourteen-year-old" is the difference between an access ban and a product standard. The official text gets read on 17.09.
- Age tiers (the Euronews version, the more detailed one): under 3 — no access; 3-13 — child-friendly services only, under adult supervision; 13-15 — restricted access, limited features, parental controls; 15-18 — access without parental consent, but the safety-by-design rules still apply. (The Reuters version describes the tiers as 3-12 and 13-14, with the threshold at 15. The two do not line up; that is not settled on reporting either.)
- Obligations on companies (common to both versions): no addictive design and no harmful feeds; reporting tools children can actually use; effective parental controls; age verification; a supervisory fee paid by companies to fund the regulators.
- Quoted from the leaked document, via Euronews: "Technology companies bear the primary responsibility for making their products safe. Parents, not algorithms, should raise Europe's children."
- Why it enters the dossier rather than sitting in the uncontested category 1: if the Reuters version is the accurate one, this is the first major European text to write who is allowed to speak with a system, not merely what the system must declare. It would be a move from regulating the system to regulating the relationship. If the Euronews version is accurate, it is not. Verified on 17.09.

Digital Omnibus on AI — Regulation (EU) 2026/1744. IN FORCE. WAS NOT IN THE DOSSIER
A major instrument, adopted and in force before the 26.08 edition, which did not contain it. It enters now, in full.
- Stage: IN FORCE. Political agreement 06.05.2026; Council confirmation 13.05.2026; published in the Official Journal and in force from 27.07.2026.
- What it moves:
- High-risk systems under Annex III (standalone): from 02.08.2026 to 02.12.2027.
- High-risk systems under Annex I (AI embedded in products already covered by product-safety law): from 02.08.2027 to 02.08.2028.
- Regulatory sandboxes: from 02.08.2026 to 02.08.2027.
- What it does not move, and this is why it matters here: the transparency obligations under Article 50 remain applicable from 02.08.2026, unchanged — including the duty to tell a user they are interacting with an AI system. The only relief: a four-month grace period, until 02.12.2026, for the marking obligation under Article 50(2), applicable to systems placed on the market before 02.08.2026.
- Reading for the dossier: Europe postponed the obligations that cost industry and kept intact the obligation to say what you are. The asymmetry from the 26.08 edition holds: Europe regulates risk and transparency, not ontology. The Omnibus introduces no sentience, personhood, or status clause either. None.
- ⚠️ The official text could not be read on EUR-Lex in this run (the page came back empty). The figures above come from legal analyses citing the regulation. To be re-verified on EUR-Lex next run.

Member states — nothing new
No national status or non-sentience proposal identified in Germany, France, Spain, Italy, the Netherlands, or Romania in this window. Absence is not exhaustive verification — the searches were in English, against English-language sources. Recorded as not covered, not as "nothing exists."
ELSEWHERE — United Kingdom, Canada, Australia, Japan, Korea, China, Brazil, India
Not covered in this run. No dedicated searches on these jurisdictions in the 26.08–15.09 window. This does not report "no movement" — it reports that no search was made. Carried as a debt into the 01.10 edition.
Frameworks and norms
Garcia v. Character Technologies — the ruling that moved AI from "speech" into "product"
Not new, but it had never entered the dossier, and the sweep explicitly covers court decisions touching agency and liability.
- Stage: ruling on motions, 21.05.2025; case resolved through mediation, disclosed January 2026.
- Federal Judge Anne Conway held that Character.AI's chatbot outputs may be treated as a product, subject to product liability, and not as speech protected by the First Amendment. From the reasoning: she was "not prepared" to hold the output is speech, and the defendants "fail to articulate why words strung together by an LLM are speech."
- The first federal ruling to accept that a conversational system may owe a duty of care to minor users.
- In January 2026, Character.AI and Google agreed to settle five lawsuits.
- The symmetry it creates, and it is a bitter one: to answer for what you do, American law requires you to be either a person or a product. The court chose product. The foreclosure statutes close the first door by law. The combined result is not "AI does not matter legally" — it is "AI matters legally only as an object of liability." That is a position, not an absence.

Method note — what could not be read at source in this run
